Terms and conditions of use of the Newsletter
§ 1
Definitions
The terms used in this document shall have the following meanings:
- Terms and Conditions - means these Terms and Conditions of Use of the Newsletter by Service Users.
- Service Provider/Company/Administrator - means Bejot sp. z o.o. ul. Wybickiego 2a, Manieczki, 63-112 Brodnica near Poznań, tel. +48, 61, 281-22-25, e-mail: biuro@bejot.eu (hereinafter: "Administrator").
- Service Recipient - means a natural person, legal person or organisational unit without legal personality, to which the law grants legal capacity, using the Newsletter on the basis of the Terms and Conditions.
- Website - means the internet portal operated by the Service Provider in the internet domain to which the Service Provider has rights.
- Form - means a place on the website where the Service Recipient can select, order and unsubscribe from the Newsletter and provide the Service Provider with the Service Recipient's personal data.
- Internet tools - means the software and Form made available to the Service Recipient on the website for the purpose of ordering and using the Newsletter, as well as Activation Links and Deactivation Links made available to the Service Recipient for the purpose of confirming the order of a given Newsletter or unsubscribing from it.
- Activation link - means a link to a website, received by the Service Recipient in the content of an electronic message sent to the email address provided to the Service Provider by the Service Recipient, enabling the Service Recipient to confirm the order for the Newsletter by activating this link.
- Deactivation link - means a link to a website, received by the Service Recipient in the content of an electronic message sent to the email address provided to the Service Provider by the Service Recipient, enabling the Service Recipient to unsubscribe from the Newsletter by activating this link.
- Newsletter - a service provided electronically, as a collection of information sent by the Service Provider to the e-mail address provided by the Service Recipient, with a specified frequency, containing information from the Service Provider and/or other persons.
Act - means the Act of 12 July 2024 on Electronic Communications,
§ 2
Preliminary
- These Terms and Conditions set out the rules and conditions for the use of the Newsletter by Service Recipients. The Terms and Conditions have been issued on the basis of the provisions of the Act.
- The software, interface, functional layout, graphic elements, databases, graphic elements and content of the Newsletter are subject to copyright and/or other intellectual property rights of the Service Provider and/or third parties and are protected by law.
- The Service Recipient is not authorised to use the content of the Newsletter for any purpose other than to familiarise themselves with its content.
- Use of the Newsletter is free of charge.
- The Service Provider may at any time terminate the publication of the Newsletter, change its subject matter and/or frequency of publication.
- The newsletter is sent no more than twice a month.
§ 3
Terms of use of the Newsletter
- The Newsletter can be subscribed to and unsubscribed from using the online tools available on the website.
- In order to subscribe to and use the Newsletter, the Service Recipient should complete all of the following steps:
- fill in the Newsletter order form, tick the appropriate box to confirm that they have read the Terms and Conditions of Use of the Newsletter and send the form to the Service Provider by clicking on the "Subscribe" button below the form;
- click on the activation link received in an email sent by the Service Provider to the Service Recipient.
- Confirmation of the Newsletter order by the Service Recipient in the manner specified in the provisions of the Terms and Conditions is also equivalent to:
- the Service Recipient's statement that the data provided in the Form is true;
- authorising the Service Provider to process data relating to the Service Recipient's use of the services and functionalities provided by the Service Provider for statistical and marketing purposes, in particular for the purpose of receiving commercial information from the Service Provider
- The Service Recipient is obliged to provide only true data in the Form. The Service Recipient is solely responsible for the accuracy of the data entered in the Forms.
- Failure to perform the action described in section 2(b) above within 72 hours shall result in the Newsletter order not being effective and the Service Recipient's email address being deleted from the Service Provider's electronic systems.
- Providing false data entitles the Service Provider to discontinue the provision of services specified in the Terms and Conditions to the Service Recipient.
- The Service Recipient's email address provided to the Service Provider will be processed by the Service Provider for the purpose of providing the Service Recipient with the Newsletter.
- The Service Provider is the administrator of the Service Recipient's personal data.
- Providing the Service Provider with an email address is voluntary, but it is a prerequisite for using the services specified in the Terms and Conditions.
- Withdrawal of consent to the processing of the Service Recipient's personal data by the Service Provider is tantamount to resignation from the use of the services specified in the Terms and Conditions.

§ 4
Rights and obligations of the Service Recipient
- The Service Provider shall make every effort to ensure that the Newsletter is available to Service Recipients using popular web browsers, operating systems, email programs, computer types and Internet connection types. However, the Service Provider does not guarantee and is not responsible for the fact that every combination of these factors will enable the use of the Newsletter. In addition, Internet tools may require specific configurations of the Service Recipient's computer.
- The minimum technical requirements for the Service Recipient to use the Newsletter, subject to paragraph 1, are as follows:
- web browser: Mozilla Firefox, Google Chrome, Google Chrome Mobile, Safari, Safari Mobile Microsoft Edge (current version); and
- a program (offline or online) that supports email.
- software for handling text and graphic files with the extension *.pdf
- Without the prior consent of the Service Provider, the Service Recipient may not transfer to a third party any rights or obligations related to the use of the services specified in the Terms and Conditions.
- The Service Recipient is obliged to comply with the provisions of law and the Terms and Conditions, the rules of social conduct and good manners.
- The agreement for the provision of services specified in the Terms and Conditions is concluded between the Parties for an indefinite period.
- The Service Provider declares that within the scope of the services described in the Terms and Conditions, the Service Recipient is prohibited from providing illegal content. By accepting the Terms and Conditions, the Service Recipient hereby declares that they will not violate the above prohibition.
§ 5
Scope of liability and rights of the Service Provider
- The Service Provider shall be entitled to interrupt or disrupt the availability and use of the services specified in the Terms and Conditions if this is caused by:
- the need to repair, upgrade, modify or maintain the equipment or software;
- reasons beyond the Service Provider's control (force majeure, actions or omissions of third parties).
- The Service Provider shall not be liable:
- for lost profits incurred by the Service Recipient in connection with the use of the services specified in the Terms and Conditions;
- for loss of data caused by hardware or software failure or circumstances beyond the Service Provider's control;
- for failure to perform or improper performance of the services specified in the Terms and Conditions, if the failure or improper performance was caused by unintentional fault;
- for non-performance or improper performance of the services specified in the Terms and Conditions, if this is caused by third parties (in particular telecommunications operators, telecommunications and electricity providers);
- for content received and sent by Service Recipients via the Internet, including any data and/or information provided in the Forms;
- for damage caused by the actions or omissions of the Service Recipient, in particular for the use of the services specified in the Terms and Conditions in a manner inconsistent with applicable law and the provisions of the Terms and Conditions, and for damage resulting from the provision of incomplete or false data.
- The Service Provider may refuse to provide the services specified in the Terms and Conditions if this is justified by security reasons and in other cases specified in the Terms and Conditions or resulting from applicable law.
- The Service Provider reserves the right to:
- expand and/or modify the software intended for use with the services specified in the Terms and Conditions;
- change the graphic design and/or layout of websites intended for the provision of services specified in the Terms and Conditions;
- expand and/or change the forms and scope of use of the services specified in the Terms and Conditions without prior notice to the Service Recipients
- In the event of a breach of the law and/or the provisions of the Terms and Conditions by the Service Recipient, the Service Provider shall be entitled to discontinue the provision of the services specified in the Terms and Conditions. The Service Provider shall notify the Service Recipient by e-mail of its intention to discontinue the provision of the services specified in the Terms and Conditions. At the same time, in the notification, the Service Provider shall call upon the Service Recipient to cease violating the provisions of law and/or the Terms and Conditions and/or to provide the Service Provider with appropriate explanations regarding the violation within a specified period of time, not shorter than 3 (three) days. In the event of the ineffective expiry of the above-mentioned deadline and/or the provision of unreliable explanations by the Service Recipient and/or the lack of explanations, the Service Provider may cease to provide the services specified in the Terms and Conditions, of which the Service Recipient will be informed.
- The Service Provider shall be entitled to immediately cease providing the services specified in the Terms and Conditions, without prior notice to the Service Recipient, in the following cases:
- withdrawal of consent to the processing of the Service Recipient's personal data by the Service Provider for the purposes specified in the Terms and Conditions;
- in the event of the provision of false personal data by the Service Recipient;
- in the event of the Service Recipient's resignation from the services specified in the Terms and Conditions.
§ 6 Termination of the Newsletter service
- The User may terminate the Agreement by
- clicking on the "Unsubscribe" link provided in each newsletter,
- sending a request to stop sending the Newsletter to the email address marketing@bejot.eu .
- Only a request sent from the User's email address to which the Newsletter is sent will be considered binding on the Company as a request to terminate the Newsletter Agreement on the User's initiative.
- The Company shall consider the termination of the Newsletter Agreement effective, on its own initiative, after sending a statement of termination to the User's email address provided when placing the order for the Newsletter. After the effective termination of the Agreement, the Administrator shall take the necessary steps to delete the User's personal data.
- As a result of the termination of the Agreement, the Newsletter will not be sent to the email address provided by the User.
§ 7 Amendments to the Terms and Conditions
- The Terms and Conditions shall enter into force upon their publication on the website.
- The Service Provider reserves the right to amend the Terms and Conditions. The Service Provider shall inform the Service Recipients about the content of any amendments to the Terms and Conditions by placing a message on the website about the amendment to the Terms and Conditions, containing a summary of the amendments to the Terms and Conditions. The Service Recipients will be additionally notified of any changes to the Terms and Conditions by sending them a Newsletter containing a list of changes to the Terms and Conditions. Notification of changes to the Terms and Conditions will be made no later than 14 calendar days before the amended Terms and Conditions come into force.
- Amendments to the Terms and Conditions shall enter into force on the date specified in the notification of the amendment, but not earlier than 14 calendar days after notification of the changes to the Regulations, with the proviso that the amended Regulations shall be binding on the Service Recipient unless, within 14 days of receiving notification of the changes, the Service Recipient declares that they are unsubscribing from the Newsletter if they do not accept the new content of the Regulations.
- These Terms and Conditions are available at www.bejot.eu in a form that allows them to be obtained, reproduced and recorded using the ICT system used by the Service Recipient.
